Terms of Service

These Terms govern your use of the TOLOCA mobile application. By using TOLOCA, you agree to these Terms.

1. About TOLOCA

TOLOCA is a marketplace platform connecting users for services, tasks, rentals, and related activities. TOLOCA acts solely as a technology platform. TOLOCA is not an employer, contractor, transportation provider, rental property owner, or direct provider of any services.

2. Eligibility

You must be at least 18 years old. You confirm that all information you provide is accurate and that you will comply with these Terms and applicable laws of the Republic of the Philippines.

3. User Accounts

You are responsible for maintaining account security and all activity under your account. You must not impersonate others, create fake accounts, or attempt unauthorized access.

4. Marketplace Activities and Payments

TOLOCA does not process payments in-app. All payments are peer-to-peer (cash, bank transfer, GCash, Maya). Users are solely responsible for pricing, service quality, legality, safety, and offline interactions. TOLOCA does not guarantee identity accuracy, service quality, or user conduct.

5. Prohibited Activities

Users may not violate laws, publish illegal or fraudulent content, harass other users, distribute spam or malicious code, infringe intellectual property, or bypass platform security.

6. User Generated Content

You retain ownership of your content. By uploading content, you grant TOLOCA a non-exclusive, worldwide, royalty-free license to host, display, and distribute it for platform operation.

7. Moderation and Safety

TOLOCA enforces a zero-tolerance policy against objectionable content. Users can report and block other users. TOLOCA reviews reports as soon as reasonably possible and prioritizes urgent safety issues. Actions include content removal, feature restriction, suspension, or termination.

8. Reviews and Ratings

Reviews must reflect genuine experiences. False or retaliatory reviews are prohibited. TOLOCA may remove violating reviews.

9. Account Suspension, Termination, and Deletion

TOLOCA may suspend or terminate accounts for violations. You may delete your account via Settings → Privacy & Data → Delete My Account or by emailing support@toloca.app.

Deletion removes your entire account including both Client and Specialist profiles. Deletion may be blocked while you have active obligations. You remain responsible for obligations created before deletion.

TOLOCA may retain or anonymize certain records after deletion as described in our Privacy Policy.

10. Intellectual Property

The TOLOCA application, branding, and original content are protected by intellectual property laws. You may not copy, modify, or commercially exploit the platform without authorization.

11. Third-Party Services

TOLOCA relies on third-party infrastructure (such as Google Firebase). TOLOCA is not liable for service interruptions caused by external providers.

12. Limitation of Liability

TOLOCA is provided “as is” without warranties. The developer is not liable for user behavior, disputes between users, physical injuries, property damage, or financial losses from offline interactions. Your interactions with other users are at your own risk.

13. MVP Status

TOLOCA is in its Minimum Viable Product phase. Features and policies may change without prior notice.

14. Governing Law

These Terms are governed by the laws of the Republic of the Philippines.
